Legal Analysis of NSA spying

Orin Kerr at the Volokh Conspiracy has a long legal analysis of the secret NSA surveillance program. Since legalese is not my thing I had a little trouble following it but I think his conclusion was it did not violate the constitution but did violate FISA; I might be wrong.
